Privacy Policy

Introduction and Scope

Agro Budget System doo (“ABS”, “we”, “us”, or “our”) respects the privacy of its users and is committed to the lawful, fair, transparent, and secure processing of Personal Data.
This Privacy Policy explains what Personal Data we process when you use www.agrobudget.com and the ABS Platform, the purposes for which such data are processed, the applicable legal bases for processing, the parties to whom the data may be disclosed, how long the data are retained, and the rights available to you.
This Privacy Policy applies to website visitors, registered users, farmers, and other natural persons whose Personal Data are processed through the ABS Platform.
The use of the ABS Platform does not mean that all processing activities are based on consent. ABS applies the appropriate legal basis to each specific processing activity.

Personal Data We May Process

Depending on how you use the ABS Platform and its services, we may process the following categories of Personal Data and related information:

• account and identity information;
• farm and business profile information;
• agricultural parcel and production data, including parcel location and geometry, area, crop, production period, and production requirements;
• Digital Field Book data;
• Earth Observation (“EO”), satellite-derived, and parcel-level indicators;
• farmer requests and supplier offers;
• data generated through or exported from the ABS Platform, including GeoJSON data;
• technical and cybersecurity-related information, including IP addresses, access records, authentication records, system and application logs;
• communications with ABS; and
• cookie and analytics data, to the extent such technologies are used.

ABS does not intend, as part of the ordinary use of the Platform, to collect or process special categories of Personal Data. Users should not provide such information unless there is a specific need and an appropriate legal basis for processing.

Purposes and Legal Bases for Processing

ABS may process Personal Data for the following purposes:

• registration and administration of user accounts;
• provision and operation of Platform functionalities;
• creation and management of agricultural production plans;
• connecting farmers with companies and enabling personalised offers;
• Earth Observation and satellite-based parcel monitoring;
• operation of the Digital Field Book;
• data export and interoperability functionalities;
• customer and technical support;
• information security, cybersecurity monitoring, fraud prevention, and prevention of unauthorised use;
• compliance with applicable legal and regulatory obligations;
• product and service improvement and analytics; and
• direct marketing where an appropriate legal basis exists.

Depending on the relevant processing activity, the legal basis may include performance of a contract, taking steps at the request of a user prior to entering into a contract, compliance with a legal obligation, legitimate interests pursued by ABS or another party, or the Data Subject’s consent.
Where ABS relies on legitimate interests, we assess those interests against the rights and freedoms of affected individuals.
Where processing is based on consent, the Data Subject may withdraw that consent at any time, without affecting the lawfulness of processing carried out prior to its withdrawal.

Data Sharing within the Farmer–Supplier Model

A paid subscription to the ABS Platform does not, by itself, provide a company with unrestricted access to farmers’ Personal Data or other farmer-related information.
When a farmer creates a production plan, submits a request for an offer, or uses a Platform functionality involving a company, ABS may make available only the data necessary for the specific purpose concerned.
A farmer’s identity and contact information, precise parcel-level data, Digital Field Book data, and other higher-detail information are not automatically made available to companies solely because they subscribe to a commercial ABS package.
Access to such information depends on the relevant Platform functionality, the specific purpose of the processing, the applicable legal basis, and the technical access-control rules implemented by ABS.
ABS may use aggregated or anonymised information that no longer identifies an individual for statistical analysis, analytics, product development, service improvement, and business planning purposes.

Recipients and Service Providers

Personal Data may be accessed by authorised ABS personnel and, where necessary, by contracted service providers supporting services such as:

• hosting and cloud infrastructure;
• email services;
• technical support;
• cybersecurity and information security;
• analytics;
• Earth Observation services; and
• Platform integrations.

Personal Data may also be made available to companies or suppliers participating in a specific Platform functionality or responding to a user request, but only to the extent necessary for that specific purpose.
Personal Data may be disclosed to competent public authorities where ABS is required to do so under applicable law.

ABS does not sell users’ Personal Data.

International Data Transfers

Certain technology and service providers used by ABS may process Personal Data outside the Republic of Serbia or the European Economic Area (“EEA”).
Where an international transfer of Personal Data takes place, ABS applies an appropriate legal transfer mechanism and appropriate safeguards as required by applicable data protection law.

Data Retention

ABS retains Personal Data only for as long as necessary to fulfil the purposes for which the data were collected and processed, for the duration of the relevant user or contractual relationship, and for any additional period required to:

• comply with applicable legal obligations;
• establish, exercise, or defend legal claims;
• resolve disputes; or
• maintain information security and cybersecurity.

Where Personal Data are no longer required and there is no legal basis for continued retention, they are securely deleted or irreversibly anonymised.
Personal Data contained in backup systems are removed in accordance with the applicable backup retention and lifecycle procedures.

Information Security and Cybersecurity

ABS implements appropriate technical and organisational measures (“TOMs”) designed to protect Personal Data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, unauthorised access, and other forms of unlawful or unauthorised processing.

Depending on the relevant system, processing activity, and associated risk, these measures may include:

• role-based access control (“RBAC”);
• application of the principle of least privilege;
• protection of privileged and administrative accounts;
• secure authentication and credential management;
• protection of data communications;
• logging and monitoring of relevant security events;
• backup and recovery procedures;
• vulnerability management;
• access management;
• security incident management; and
• procedures for responding to Personal Data Breaches.

Access to Personal Data is restricted to authorised persons who require such access for legitimate business or operational purposes.
While ABS implements safeguards appropriate to the risks associated with its processing activities, no information system, network, or method of electronic transmission can guarantee absolute security.

Your Data Protection Rights

Subject to applicable data protection law, you may have the right to:

• obtain confirmation as to whether ABS processes your Personal Data;
• request access to your Personal Data;
• request rectification of inaccurate or incomplete Personal Data;
• request erasure of Personal Data where the applicable legal requirements are met;
• request restriction of processing;
• exercise the right to data portability where applicable;
• object to certain processing activities; and
• withdraw consent at any time where consent constitutes the legal basis for processing.

To protect Personal Data against unauthorised disclosure or access, ABS may request information reasonably necessary to verify the identity of the person submitting the request.
You also have the right to lodge a complaint with the Commissioner for Information of Public Importance and Personal Data Protection of the Republic of Serbia.

Automated Decision-Making

ABS does not currently intend to make decisions based solely on automated processing that produce legal effects concerning an individual or similarly significantly affect that individual.

If such functionality is introduced in the future, this Privacy Policy will be updated and the information and safeguards required under applicable data protection law will be provided.

Cookies and Analytics

ABS may use strictly necessary cookies and similar technologies required for the proper operation, security, and functionality of the website and the ABS Platform.

Analytics, marketing, and other non-essential cookies or similar technologies are used in accordance with applicable requirements and, where required, subject to the user’s choice or consent.

Further information may be provided through a separate Cookie Policy and/or cookie preference management interface.

Children’s Personal Data

The ABS Platform is intended for professional agricultural users and business users and is not directed at children.
ABS does not knowingly seek to collect Personal Data relating to children through the ordinary use of the Platform.
If ABS becomes aware that such Personal Data have been collected without an appropriate legal basis, appropriate measures will be taken in accordance with applicable law.

Passwords, Authentication, and Account Access

ABS does not send or disclose an existing user password in readable or plain-text form.
The “Forgot Password” functionality is designed to provide the user with secure instructions or a secure link enabling the user to set a new password through the registered email address.
Users are responsible for maintaining the confidentiality and security of their account credentials and must not disclose them to unauthorised persons.

Third-Party Links

The ABS website and Platform may contain links to websites, applications, or services operated by third parties.
The processing of Personal Data by such third parties is governed by their respective privacy policies and practices.
ABS is not responsible for the independent privacy, data protection, or information security practices of third-party services.

Changes to This Privacy Policy

ABS may update this Privacy Policy from time to time to reflect changes in Platform functionality, business processes, data-processing activities, cybersecurity practices, or applicable legal and regulatory requirements.
The current version of this Privacy Policy will be published together with the date of the most recent update.
Where a change materially affects the processing of Personal Data or the rights of Data Subjects, ABS will provide additional notice where required by applicable law.

Digital Field Book – Data Processing and Retention

When a user uses the Digital Field Book (“DFB”), ABS may process data associated with a specific farm, agricultural parcel, and production season.

Such data may include:

• parcel identification and geometry;
• crop information;
• dates and types of agronomic operations;
• sowing or planting activities;
• soil cultivation activities;
• fertilisation;
• crop protection activities;
• irrigation;
• harvesting;
• agricultural inputs and quantities used;
• phenological information;
• notes entered by the user;
• timestamps; and
• other agronomic records entered by the user or generated through the use of the DFB functionality.

ABS processes these data for the purposes of maintaining digital agricultural production records, providing historical activity records, supporting traceability, analysing production processes, enabling data exports, and providing other functionalities requested by the user.
Where the Digital Field Book is integrated with an external service or technology provider, ABS may transmit only the data necessary for the operation of the relevant integration, subject to appropriate contractual, technical, organisational, and security safeguards.
Digital Field Book data are not automatically made available to all companies registered on the ABS Platform.
Any access to relevant DFB data depends on the functionality used by the farmer, the purpose of the specific request, the applicable legal basis, and the access-control rules established by ABS.
DFB data are retained for as long as necessary to provide the relevant functionality, maintain the historical records used by the user, and comply with applicable legal or contractual obligations.
Following expiry of the applicable retention period, the data are securely deleted or anonymised in accordance with ABS’s internal Data Retention and Deletion Policy.

Earth Observation (EO) and Satellite-Based Parcel Monitoring

When a user activates or uses Earth Observation (“EO”) or satellite-based parcel monitoring functionality, ABS processes spatial data necessary to identify and monitor the relevant agricultural parcel within the EO service.

Such data may include:

• parcel geometry and boundaries;
• parcel location;
• parcel identifiers;
• crop information;
• production season; and
• other parameters necessary for the provision of the EO service.

Based on satellite imagery and other Earth Observation data sources, ABS may generate, process, or display derived indicators relating to parcel and vegetation conditions.

Depending on the functionality available, these may include:

• Normalized Difference Vegetation Index (“NDVI”);
• Enhanced Vegetation Index (“EVI”);
• Normalized Difference Red Edge Index (“NDRE”);
• cloud masks; and
• other vegetation, environmental, or agronomic indicators.
ABS may retain EO results and historical values where necessary to enable users to monitor changes in agricultural parcels over time.

Satellite-based monitoring within the ABS Platform is intended to monitor agricultural parcels, vegetation conditions, and agricultural production conditions.

It is not intended to capture images of individuals or to track the physical movements or location of farmers.

Where ABS uses an external EO service provider, ABS provides only the spatial and other data necessary to perform the relevant functionality, subject to appropriate contractual, technical, organisational, cybersecurity, and, where applicable, international data transfer safeguards.

Detailed EO information associated with a specific parcel and user does not automatically become available to all supplier companies using the ABS Platform.

Access to such information depends on the functionality used by the farmer, the specific request, the purpose of processing, the applicable legal basis, and the technically defined level of access.

EO results and historical data are retained for as long as necessary to provide the service and the historical monitoring functionality used by the user.

Following expiry of the applicable retention period, such data are securely deleted or anonymised in accordance with ABS’s internal Data Retention and Deletion Policy.
